Woman Strangled – Man Charged With Aggravated Assault in Domestic Dispute [DOCUMENT]

On Sunday, September 29, Eric Aimsback allegedly beat and attempted to strangle the woman he lives with, Phyllis Kipp, after a night of drinking at a bar and casino.

Aimsback, 26, appeared via video from the Missoula County Detention Center in Missoula Justice Court. The Missoula County Attorney’s Office charged Aimsback with felony aggravated assault, misdemeanor partner or family member assault, and misdemeanor unlawful restraint.

Court records indicate that Aimsback and Kipp were arguing after returning back to their apartment on 34th Street from the Gray Wolf Peak Casino, when Kipp attempted to hide in their children’s room. Aimsback dragged her off the bed and pushed her to the ground. She tried to hide in the bathroom, but Aimsback kicked in the door and strangled her until she lost consciousness. A neighbor helped Kipp call her son and they left the apartment.

Police responded and arrested Aimsback, and he was transported to the Missoula County Detention Center.

Felony aggravated assault carries a maximum sentence of 20 years in prison and a possible $50,000 fine. Misdemeanor partner or family member assault carries a possible one-year sentence, while misdemeanor unlawful restraint could result in another six months in jail.

He was placed back in jail on $15,000 bond.
