26-year-old Ashli MacDonald is back in the Missoula County Jail after she was arrested Wednesday evening by Missoula Police.

"About 3:45 p.m. one of our officers responded to the 100 block of Pullman Court, to assist U.S. Marshals, who had come into contact with 26-year-old Ashli MacDonald," said Missoula Police Public Information Officer Travis Welsh. "It was determined that MacDonald had failed to update her living status as a registered violent offender, so she was taken into custody."

Macdonald was originally charged and convicted with aggravated assault and assault on a minor after she broke her seven month old infant’s arm and leg in two separate instances of anger at the child’s crying. MacDonald was given a suspended sentence and never went to prison, but this new act may change that.

"If someone is in non-compliance, and that basically amounts to living somewhere where they haven't notified the state or changing their resident status without making notification... the statute for failing to register as a sexual or violent offender is a felony," Welsh said.

During sentencing after the original trial, the child’s father had requested that MacDonald receive some time in jail saying “Every parent's greatest fear is that their child is going to get hurt and that happened to us, it happened to me. My biggest fear now is that it's going to happen again.” MacDonald is currently held on $10,000 bond.
