27 year-old Daniel Martin was charged in Missoula Justice Court on Wednesday with Felony Aggravated Assault resulting in permanent or life-threatening injury and Partner or Family member Assault.

According to court documents, Martin was arrested on May 26 after attempting to break down his partner, Jane Doe's door. When officers arrived, they saw that her jaw had been wired shut due to an assault that occurred on May 22. On that night, Martin is alleged to have been smoking hash oil at Jane Doe's home on Alex Lane, when she entered and reminded him that she did not allow smoking in her residence. Court records say that Martin threw her to the ground and repeatedly drove his knee into her face, breaking her jaw.

At his court appearance on Wednesday, Deputy Missoula County Attorney Brittany Santorno asked Judge Marie Anderson for a high bail, since Martin was a repeat offender, and that both alcohol and drugs were involved in the assault.

"The State would request a $50,000 bail," Santorno said. "The defendant is a danger to the community. He perpetrated a brutal assault on the victim, breaking her jaw by kneeing her in the face repeatedly so badly that she had to have her jaw wired shut at the emergency room. At the time of the assault the defendant was smoking hash oil and was drinking prior to that at the Silver Slipper. He is clearly a danger to the community and to the victim. He needs to be monitored if he is released."

Martin, who appeared without a public defender via video from the jail, told Judge Anderson that $50,000 bail was 'crazy', and that he requested a more reasonable bond so that he could continue working.

Judge Anderson set Martin's bail at $50,000, and he was remanded back to the jail. His next court appearance will be June 6.
